These Terms of Service ("Terms") govern your use of the Spoon mobile application ("App," "Spoon," "we," "us," or "our"), operated by ThreeSix Labs, Inc., a Delaware corporation. By downloading, installing, or using Spoon, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
By accessing or using Spoon, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Spoon is available for users aged 4 and older. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting updated Terms within the App or through other reasonable means. Your continued use of the App after such notice constitutes acceptance of the modified Terms.
Spoon is a recipe management application that helps users save, organize, and discover recipes from across the web, TikTok, and other sources, plan weekly meals, and generate grocery lists.
The App provides:
When you save recipes from third-party websites or TikTok, you are responsible for ensuring you have the right to use that content for personal, non-commercial purposes. We do not claim ownership of third-party recipe content.
Spoon requires account creation to sync your data across devices. You are responsible for maintaining the security of your account credentials.
Spoon offers the following subscription options:
Subscriptions are billed through your Apple App Store account. Payment will be charged to your Apple ID upon confirmation of purchase (or after the free trial period ends, if applicable).
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period.
If you subscribe to a plan with a free trial, you may cancel during the trial period without being charged. If you do not cancel before the trial ends, you will be charged the full subscription price.
All payments are processed through Apple's App Store. Refund requests must be directed to Apple in accordance with Apple's refund policies. We do not control or process refunds directly.
We reserve the right to change subscription prices with at least 30 days' notice. Price changes will not affect active subscriptions until renewal.
You agree to use Spoon only for lawful purposes and in accordance with these Terms.

You retain ownership of content you create or upload (such as personal recipe notes and photos). By uploading content, you grant us a license to store and display it within the App solely to provide the service to you.
You are responsible for ensuring your device meets the technical requirements to run Spoon and for maintaining compatible iOS versions.
Spoon, including all content, features, functionality, software, code, designs, graphics, and user interface, is owned by ThreeSix Labs, Inc. and is protected by United States and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded products that you own or control, for personal, non-commercial purposes, in accordance with these Terms and the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license may be extended to other accounts associated with you via Family Sharing, volume purchasing, or Legacy Contacts as permitted by Apple.

SPOON IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The App integrates with third-party services including Firebase and RevenueCat. We are not responsible for the performance, availability, or practices of these third-party services.
Spoon is a recipe organization tool. It does not provide dietary, nutritional, or medical advice. Consult a qualified professional for dietary guidance.
ThreeSix Labs, Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be ThreeSix Labs, Inc.'s sole responsibility.
TO THE FULLEST EXTENT PERMITTED BY LAW, THREESIX LABS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless ThreeSix Labs, Inc., its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, judgments, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use or misuse of the App, your violation of these Terms, or your violation of any rights of another party.
You may stop using the App at any time by deleting your account and uninstalling the App from your device.
We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.
Upon account deletion:
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and judgment on the award may be entered in any court having jurisdiction.
YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThreeSix Labs, Inc. regarding the App.
In connection with your download and use of the App through the Apple App Store, you and ThreeSix Labs, Inc. acknowledge and agree to the following:
These Terms are concluded between you and ThreeSix Labs, Inc. only, and not with Apple, Inc. ("Apple"). ThreeSix Labs, Inc., not Apple, is solely responsible for the App and the content thereof. The license granted under these Terms may not conflict with the Apple Media Services Terms and Conditions.
ThreeSix Labs, Inc. is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You and ThreeSix Labs, Inc. acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
You and ThreeSix Labs, Inc. acknowledge that ThreeSix Labs, Inc., not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
You and ThreeSix Labs, Inc. acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, ThreeSix Labs, Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
You represent and warrant that: (i) you are not located in a region that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" region; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with all applicable export and re-export control laws and regulations in your use of the App.
When using the App, you must comply with applicable third-party terms of agreement. For example, you must not be in violation of your wireless data service agreement when using data-connected features of the App.
